Terms of Service

Please read these Terms carefully before using Geompact. They govern your access to and use of the platform.
1. Acceptance of Terms
By accessing or using Geompact ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms constitute a binding agreement between you and Geompact ("we", "us").
2. Accounts
You must be at least 16 years old to create an account. You are responsible for maintaining the security of your credentials and for all activity under your account. Notify us immediately at hey@geompact.com if you suspect unauthorized access.
3. Acceptable Use
You agree not to use the Service for any unlawful purpose, to upload content that infringes third-party intellectual property rights, to attempt to reverse-engineer or scrape the Service, or to abuse the platform in ways that degrade its performance for other users. 4. Intellectual Property
You retain all ownership rights to the 3D models and files you upload. By uploading content, you grant Geompact a limited, non-exclusive, royalty-free license to process that content solely for the purpose of providing and improving the Service. We may use anonymized, aggregated metadata (such as file sizes, polygon counts, and optimization ratios) for internal analytics and public benchmarks, but will never share identifiable models or files. Geompact does not use your models to train AI models. Third-party AI services used in processing operate under API terms that prohibit training on customer data.
5. Subscriptions & Billing
All payments are processed by Paddle.com, which acts as Merchant of Record for all transactions. Paddle handles billing, invoicing, sales tax, and VAT on our behalf. Your purchase is subject to Paddle's Terms of Sale (paddle.com/legal/terms-of-sale) in addition to these Terms. Paid plans are billed in advance on a monthly or annual basis. Prices displayed are exclusive of applicable taxes, which Paddle calculates and collects at checkout. Failed payments may result in service suspension. We reserve the right to change pricing with 30 days' notice.
6. Refunds
Refunds are governed by our Refund Policy. In summary: first paid subscriptions may be refunded within 14 days of the initial charge. If you have consumed more than 25% of your monthly token allocation before requesting a refund, the refund will be prorated to reflect tokens already used. Renewals and partial billing-period usage are generally non-refundable unless required by applicable law.
7. Termination
You may cancel your account at any time from account settings. We may suspend or terminate your account for material violations of these Terms, with or without notice. Upon account cancellation or termination, your uploaded 3D models are permanently deleted within 30 days. Analysis reports are deleted within 30 days. Billing records are retained for 7 years as required by applicable law.
8. Service Availability
We do not guarantee any specific uptime or availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control, including but not limited to third-party service outages, infrastructure failures, natural disasters, or illness. We will make reasonable efforts to notify users of planned downtime.
9. Service Modifications & Discontinuation
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. If we discontinue the Service entirely, active paid subscribers will receive a prorated refund for the unused portion of their subscription. We will provide at least 30 days' notice before any material discontinuation.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOMPACT IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Governing Law
These Terms are governed by the laws of the Republic of Serbia. Any disputes shall be resolved in the courts of Novi Sad, Serbia.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
